The Trade Agreements Act (TAA) requires that the U.S. government only purchase goods and services that are made in the United States or in countries that adhere to fair international trade practices. This law ensures that products are eligible for procurement through most contracts under the GSA Schedule—a program that facilitates the purchase of products and services by federal agencies.
To be TAA compliant (and eligible for sale under GSA contracts), a product must meet one of the following requirements:
1) Made in the U.S. or a TAA-approved Country
The entire product must be grown, made, or manufactured in the United States or in one of the countries that the U.S. has a trade agreement with.
2) Substantially Changed in a TAA-approved Country
If a product was made somewhere else, it can still qualify if it is significantly changed in the U.S. or a TAA-approved country—so much so that it becomes a new and different item, with a new name, purpose, or function.
Only products that are made—or meaningfully transformed—in approved countries can be sold through GSA contracts.
