Pursuant to Regulation (EU) 2023/2854 of the European Parliament and of the Council of 13 December 2023 on harmonised rules for fair access to and use of data (the “EU Data Act”), Belkin International, Inc. (“Belkin”) provides the following pre-contractual disclosures regarding the generation, collection, retention, access, and sharing of data arising from the use of Belkin connected products and related services (collectively, the “Belkin Connected Products”).
- Data Generated by Belkin Connected Products
In the ordinary course of operation of Belkin Connected Products, certain categories of data are generated as technical byproducts necessary for the functioning of such products. Such data may include, without limitation, device sensor outputs (e.g., button activation, keypresses, device motion detection, and microphone audio) and operational status information (e.g., connectivity status, pairing identifiers, and power usage).
The nature, scope, and volume of such data depend on the specific Belkin Connected Product, its firmware or software version, user-selected configurations, and the manner of product use. Real-time raw sensor data is generally processed instantaneously and is not retained in unprocessed form beyond its immediate functional use.
- Storage, Retention, and Purpose of Use
As a general rule, Belkin Connected Products do not collect data generated by those products. Data is typically processed locally on the device or within the application and discarded immediately or within a short window of time, generally not exceeding twenty-four (24) hours, except where necessary to maintain product functionality. In certain cases, limited device-level data may persist locally until overwritten or cleared through a system reset.
- Access to Data by the End User
As no data is collected during the use of Belkin Connected Products, no collected data is available to Belkin, third parties, or to the end user. Real-time data that is generated during the use of the product may be accessed via the user interface of the device or an associated application.
- Access by Authorized Third Parties
As no data is collected during the use of Belkin Connected Products, no collected data is available to be accessed by third parties.
Certain Belkin Connected Products (e.g., keyboards, mice, and microphones) are designed specifically to provide generated data to third party devices and applications (e.g., the connected computer and operating system). Use of these Belkin Connected Products in this manner implies the user’s consent to this data transfer, and the user’s authorization of the third-party device and operating system to access this data.
- Termination
An end user’s use of a Belkin Connected Product authorizes that product to generate data, and to share such data with authorized third party devices and operating systems, as necessary for the functioning of such product.
Termination of such authorization can be achieved by ceasing to use the Belkin Connected Product, and, where applicable, factory resetting the Belkin Connected Product to erase any data (e.g., settings and pairing information) contained in the device.
